Deloy Mpemba lives in Luremo, in Northern Angola. Nearby is mine operated by a company named Luminas - a partnership between Leviev, the Angola National Diamond Industry and a local retired general - a large mine. Leviev, according to his associates, owns 40%. Locals, who search for diamonds to avoid starvation are designated 'pirate miners'. They are easy prey for Luminas' security company.

On May 17, Mpemba was coming back home with some friends at the end of a day of searching. At a certain stage the group encountered a armed group of security guards hired by K&P Mineira, a private company hired to secure the mine.

"They beat me until my buttocks were swollen and I passed out," testified Mpemba, who required crutches after the incident. "When I came back to consciousness it was dark and I couldn't walk. I stayed in the place I fell until the next day. I crawled back to the neighborhood."

May peace and God’s mercy be upon you. We in the villages of Jayyous and Bil’in, who are confronting a Zionist colonizing campaign championed by the wealthy Israeli businessman Lev Leviev, bring to your attention that your son Arif Jihad Muhammad Ibn Khadra, who lives in Dubai, effectively contributes to the campaign against our villages and aids the Israeli occupation via his relations with the settlement builder Leviev and his selling of Leviev’s jewelry in Dubai.

Leviev is one of Israel’s richest persons. He supports the colonization of Palestine and benefits from it through his companies Leader, which is building the settlement of Zufim on the lands of Jayyous1, and Danya Cebus, which is building housing units in the settlement of Mattityahu East on the lands of the village of Bil’in and in the settlement of Har Homa on the lands of Jabal Abu Ghuneim. Similarly, Leviev’s companies build in the settlement of Ma’aleh Adumim, which is separating Jerusalem from the rest of the West Bank.2

Leviev also supports the Land Redemption Fund, known for the strong-arm tactics it employs to obtain Palestinian land, and the extremist settlement movement Gush Emunim.3 UNICEF and Oxfam International have announced that they will refuse any donations from Leviev because of his settlement activities in Palestine and his unethical practices in Angola and Namibia and New York.4

Leviev is considered one of the leaders of the global diamond industry. His empire consists of a number of diamond and gem companies under Lev Leviev Diamonds.5 In April 14, 2008, Leviev announced that he would open two branches of his Leviev jewelry chain in Dubai, in addition to the stores owned by your son under the name Levant, through which Leviev continues to market his jewelry as a “store within a store.”6

The partnership between your son and the Zionist settlement builder is certain; and about this there is no room for doubt. In March 2008, Thierry Chaunu, President of Lev Leviev Diamonds, attended the opening of your son’s store in the Qasr Hotel and exhibited a new collection of jewelry of jewelry by Leviev.7 This was two weeks after Leviev made public remarks about his support for the settlements. It is disgraceful and shameful that, while Leviev sees no problems building in the occupied territories “as long as Israel issues legal permits to do so,”8 your son, Arif Bin Khadra has stated that “he had heard of Leviev's practices in the West Bank but had seen no proof of the allegations” and that these allegations are not a source of principal concern in that “such questions are not asked in the diamond business.”9 He is aware of the letter sent by the families of Jayyous to Dubai urging that Leviev be denied practicing his business there. In response to this, Arif Bin Khadra said that Dubai is an international and unpoliticized city and needs international brands such as Leviev’s and “What we have learned here [Dubai] is that you don't have to talk about politics or religion if you're doing business.”10

Your son and the settlement builder, Leviev, have not denied their partnership. Their websites link Levant’s stores with Leviev’s as one chain.11 It is important to note that until now the international campaign to boycott Leviev had succeeded in preventing Leviev from opening stores in his name in Dubai.12 However, this month, and only through the efforts of your son, Leviev will be opening one of his stores in Hotel Atlantis under the name “Levant.” It is shameful that the campaign by Palestinian and Jewish activists working to bar Leviev from entering Dubai’s markets to increase his profits and from building additional settlements is being undermined by your son, who spares no effort to facilitate Leviev’s access to reach consumers in Dubai. Attached to this letter are photos taken from the internet that prove your son’s involvement in the diamond trade with Leviev through the Levant stores that are owned by him in Dubai.

The dealings of your son, Arif Bin Khadra, with the Zionist settlement builder, Leviev, betrays the Palestinian cause and is an insult to the sacrifices and pain of our people, and is a mark of shame on the foreheads of every Palestinian. We recognize that you are one of the elites of this nation, and you have offered and continue to offer much to the Palestinian struggle. As such, we request that you take a firm stand against your son’s betrayal of our people and against working in the service of the occupier that violates the rights of his people and appropriates their land. We trust that you will not betray our hopes.

Take Action

With Gazans already impoverished and struggling to survive, on November 5, Israel completely sealed Gaza's border crossings. This followed an unprovoked Israeli attack on Gaza that killed six Palestinians, despite a ceasefire, and Palestinian rocket fire in response. As a result of Israel's closure, the United Nations has been forced to stop food distribution to 750,000 needy people, and 70% of Gaza is now without power due to a lack of fuel. According to reports, even candles are now in short supply. "Let's see this for what it is." said UN spokesman Chris Gunness. "Fifty-six percent of the Gaza Strip are children. Let us not cause suffering of innocent children." Blocking witnesses, on November 13, Israel denied the entry to Gaza of 20 senior EU diplomats. Israel also has refused to allow foreign journalists to enter Gaza. Foreign Press Association chairman Steven Gutnik called the ban "a serious violation of freedom of the press" and said "it is essential that journalists be allowed to enter the Gaza Strip since it is the foreign media that serves as the world's window into Gaza. Israel allowed a trickle of aid to enter Gaza today. Gaza has 1.5 million residents, the large majority of whom are displaced refugees from 1948.

SUBJECT: Cancel November 17th Hebron Fund Banquet over Human Rights Violations

DATE: November 7, 2008

As organizations working for human rights, social justice, and peace, we call on the Marriot Marquis to cancel the November 17 fundraiser for the Hebron Fund. By allowing the Hebron Fund to fundraise on its premises, the Marriot Marquis will be directly aiding Hebron’s settlers, who are regularly described, even by Israelis, as right-wing, violent and extremists. The Marriot Marquis will be facilitating activities that directly violate international law and US foreign policy, actively promote racial discrimination, and, at least indirectly, support brutal Israeli settler attacks on Palestinian civilians and the ethnic cleansing of Palestinians from Hebron. Additionally, the Marriot Marquis may be facilitating efforts by the Brooklyn-based Hebron Fund, a registered US non-profit, to camouflage its clear support for settlement construction from the Internal Revenue Service.

In the Israeli-occupied, West Bank city of Hebron 700 Israeli settlers, living amidst 150,000 Palestinians, are attempting to expand their hold on the historic old city by taking over homes, expelling Palestinian residents, and connecting their settlements to the neighboring settlement of Kiryat Arba, with 7000 residents.[1]

There is clear evidence that the Hebron Fund and its November 17th fundraising dinner support Israeli settlement construction, in violation of international law. In a September 24th, 2008 radio interview on the fundraiser, Hebron Fund Executive Director Yossi Baumol explained, “There are real facts on the ground that are created by people helping the Hebron Fund and coming to our dinners.” [2] Creating “facts on the ground” by building settlements has been the mantra of the Israeli settlement movement since its inception. As reported by Reuters,[3] a March 2007 joint appeal by The Hebron Fund and Jewish Community of Hebron called for donations saying, “Dozens of new families can now come live in Hebron... waiting for you to be their partners in the redemption of Hebron – by providing doors, windows, heating systems and many other necessities.”[4] A 2006 report by The Hebron Fund and the Jewish Community of Hebron called for the re-establishment of the “Mitzpe Shalhevet” settlement in the Palestinian market in Hebron, after the settlement was evacuated by the Israeli army. The accompanying fundraising appeal says, “Help us move families back into the Shuk [market] and into other new areas!” And, “Please redouble your support of the Hebron Fund at this crucial time so you can be a partner in…The purchase and renovation of ancient Jewish homes, Construction of new housing.”[5] The Hebron Fund has raised $10.4 million for Hebron’s settlers from 2000 – 2006 according to its form 990s submitted annually to the IRS.[6]

According to all major human rights organizations, the UN, the International Court of Justice, and almost every government worldwide, Israeli settlements in the occupied West Bank and East Jerusalem violate international law, specifically Article 49 of the Fourth Geneva Convention which states that, “The Occupying Power shall not deport or transfer parts of its own civilian population in the territory it occupies.” Continued settlement construction contradicts the US government policy, which has repeatedly denounced Israeli settlements as an obstacle to peace, as well as Secretary of State Rice's own statements in which she has “pressed Israel to cut its own financial incentives for settlers.”[7] The Hebron Fund’s promotion of settlement construction also appears to contradict the Hebron Fund’s declaration, submitted every year on its IRS Form 990, that its "primary exempt purpose" is "to promote social and educational well being," as well as Hebron Fund Executive Director Yossi Baumol’s assurances to the American Prospect that they fund only "tours, pilgrimage, and religious study."[8]

According to a 2007 report on Hebron, “Ghost Town,” by the internationally respected Israeli human rights organizations B’Tselem and the Association for Civil Rights in Israel (ACRI), Hebron is characterized by “a phenomenon of routine and sometimes extremely violent settler abuse of Palestinians” that aims to “get them to leave the area” of the old city.[9] The Hebron Fund says that it “operates in concert with the community there [in Hebron] to assess their needs and respond in kind.”[10] Through its generalized support to Hebron’s settler community, the Hebron Fund supports, at least indirectly, these violent assaults on Palestinian civilians.

According to B’Tselem and ACRI, “The settler attacks include physical assault, including beatings, at times with clubs, stone throwing, hurling of refuse, sand, water, chlorine, empty bottles and other objects, occasionally using sharp objects, destruction of shops and doors, shattering of windows, thefts, cutting of fruit trees, destruction of merchants’ stands, and verbal insults. Also documented during the second intifada are cases in which Israelis were involved in gunfire, trying to run people over, poisoning of a water well, breaking into homes, spilling of hot liquid on the face of a Palestinian, and the killing of a Palestinian girl.”

A November, 2008 report, “Under Attack: Settler Violence against Palestinian Children in the Occupied Territory,” by the child rights organization Defence for Children International – Palestine Section[11] explains that in Hebron, “Settler children routinely verbally harass, chase, hit and throw stones at Palestinian schoolchildren. Their parents and other adults engage in similar behavior.” DCI-PS notes, as one example, that records from the Qurtuba School in Tel Rumeida, Hebron, from April 2008 “documented seven separate physical assaults on schoolchildren including hitting and stone throwing. In one such attack, settlers turned their dog loose on a young boy causing him to fall down and break his arm as he tried to run away.” The DCI-PS report includes interviews with 10 year-old Raghad Hasham Younis al-Azza who was beaten by two eighteen-year-old settler girls, 12-year-old Yousef Hisham Younes al-Azza who was beaten in the mouth with a stone by a female adult settler, causing the loss of a tooth, and with 12-year-old Islam Wael Mohammad Sharabati who was hit and kicked by a group of settlers.

Some other recent assaults and harassment committed by Hebron’s settlers have been reported by mainstream media. On November 2nd, two Israeli border police and a Palestinian photographer were injured when they were attacked with stones by Israeli settlers.[12] On October 26th, after vandalizing Palestinian homes, graves and cars, a settler in Hebron, in speaking of Israeli soldiers who had just evacuated a settlement, told Israeli Army Radio, "We hope they are defeated by their enemies, we hope that they all become (kidnapped soldier) Gilad Shalit, that they are all killed and that they are all slaughtered, because that's what they deserve.” On October 18th, settlers assaulted a Palestinian photographer and international activists attempting to harvest olives in Tel Rumeida, Hebron.[13] An April, 2007 video of a female Hebron settler harassing a Palestinian woman who was caged inside her home horrified Israelis and the international community.[14]

According to B’Tselem and ACRI, as a result of settlement expansion, settler violence and Israeli military violence, and closures, in the center of Hebron, “at least 1,014 Palestinian housing units had been vacated by their occupants… 41.9 percent of the housing units in the relevant area… Regarding Palestinian businesses, 1,829 were not open for business… 76.6 percent of all the business establishments in the surveyed area…. The practice of closing streets to Palestinians in areas near the settlements, along with the open declarations of the settlers in Hebron about their intention ‘to Judaize the city’ and live in an area ‘free of Arabs,’ show that the source of the prohibitions on Palestinian movement in this area apparently relate to the army’s surrender to the racist demands of settlers.” B’Tselem and ACRI describe the movement of Palestinians out of the old city as “quiet transfer”, and “the unlawful transfer of a protected person as a grave breach of the convention, a war crime, for which the persons responsible bear personal liability.”

The Hebron Fund clearly demonstrates on its website its support for, along with the Jewish Community of Hebron, both racial discrimination and the replacement of the Palestinian population of Hebron by Jews. Clicking on the symbol which says “Give to Hebron” on the Hebron Fund webpage[15] takes one to a donations page on the website for the Jewish Community of Hebron which says, among other things, “keep Hebron Jewish for the Jewish people.”[16]

The use of violence and terror by Israeli settlers and the Israeli military in Hebron corresponds with the broadly accepted definition of ethnic cleansing. Human Rights Watch noted in a 2004 report on Darfur that, “Although ‘ethnic cleansing’ is not formally defined under international law, a U.N. Commission of Experts has defined the term as a ‘purposeful policy designed by one ethnic or religious group to remove by violent and terror-inspiring means the civilian population of another ethnic or religious group from certain geographic areas. . . . This purpose appears to be the occupation of territory to the exclusion of the purged group or groups.’”[17] Human Rights Watch further explains that, “The individual human rights abuses that characterize ethnic cleansing are crimes against humanity and war crimes.”

These war crimes are committed to "protect" and expand the presence of the very settlers supported by the Hebron Fund. In light of the above, we strongly urge the Marriot Marquis to cancel the Hebron Fund November 17th fundraiser, which would make the Marriott a party to massive human rights abuses and illegal activities that have been condemned by both the US government and the international community.

Oxfam welcomes the opportunity to explain the mention of Oxfam America in the book Hollywood Pin Ups. Two years ago, Oxfam America was approached to be the beneficiary of a future donation from celebrity photographer Timothy White (an individual) who was creating a book to mark the anniversary of famous images from the past (Esquire's "Vargas Girls"). At some point in the process, Leviev Diamonds offered to provide diamonds for some of the photo shoots, but Oxfam was not aware of this.

Just a few weeks ago, Adalah-NY tipped us off to the fact that Leviev Diamonds were promoting their inclusion in the book and using this to claim to be Oxfam supporters. When we received a copy of the book we were able to confirm that both Oxfam and Leviev are mentioned in the book: Timothy chose to mention his support of Oxfam in the forward and he decided to describe our mission on a page at the end. On a different page, Leviev is thanked by Timothy for loaning diamonds to the photo shoots.

Given this information, Oxfam immediately acted to reiterate our position to Mr. Leviev and his representatives that he is not an Oxfam supporter or partner and may not claim to be one (which has been our position since January). We also corrected the record in this matter on the internet.

Although it's true that Oxfam and Leviev are both mentioned in this book, Oxfam reiterates our policy that we are not and never will be partners or beneficiaries of Leviev because of both his mining practices and his support of Israeli settlements on Occupied Palestinian Lands which is in contravention of International Law and a major obstacle in the road to peace. We will continue to take steps to educate all the parties involved about the reasons behind our policy and to clarify the issue for the public to the best of our ability. Oxfam is disturbed to find ourselves used in this way and we intend to be proactive in informing those in our community about the deliberate strategy of Leviev Diamonds to connect itself with unwitting charities and celebrities.

According to an article in the British daily paper The Guardian, the British Foreign Service is currently planning to rent real estate in Tel Aviv from the Africa Israel Investments Company.

As you know this company is owned by Lev Leviev, whose investments are involved in the illegal settlements construction in West Bank, destroying Palestinian communities like in the villages of Jayyous, and Bil'in, and around Bethlem and Jerusalem.

Taking into consideration the fact that settlements construction in the Palestinian Occupied Territories, including East Jerusalem, is illegal according to the International law, as well as reiterated by the EU and the Quartet statements, and a clear violation of UN resolutions, I firmly support the appeal of Adalah -NY The coalition for Justice in the Middle East and other NGOs calling your Government not to rent any real estate from Lev Leviev's companies.

I am deeply convinced that the settlements expansion and its consequences (confiscation of Palestinian land, destruction of Palestinian olive groves, disintegration of Palestinian unity) represent not only a hard obstacle for the peace process but also the destruction of any chance for a sustainable peace for both Palestinians and Israelis.

Why Jewelers of America Members Should Steer Clear of Lev Leviev’s Businesses

Jewelers of America (JA) is a member of the Council for Responsible Jewellery Practices (CRJP). All CRJP members have committed themselves to a set of laudable principles to contribute to sustainable development.

The businesses of Israeli diamantier Lev Leviev are not members of JA or the CRJP and have recently been renounced by Oxfam International and UNICEF due to their construction of Israeli settlements on Palestinian land in the West Bank in violation of international law. Companies owned by Leviev’s partner in settlement construction, Shaya Boymelgreen, are now being sued for war crimes in Canada.

JA members should not do business with Leviev’s companies because there is strong evidence that Leviev’s companies may violate the following principles of the CRJP:

The Rapaport Group’s statement on Corporate Responsibility lays out a number of important principles to ensure a “strong proactive role promoting and implementing corporate responsibility programs around the world.” Other major jewelry industry associations like Jewelers of America (JA) and the Council for Responsible Jewellery Practices (CRJP) have committed themselves to similar laudable principles to respect human rights and contribute to sustainable development.

Members of the diamond industry should not do business with the companies of Israeli diamantier Lev Leviev because there is strong evidence that Leviev’s businesses violate the Rapaport Group’s principles on corporate responsibility as well as those of the JA and CRJP. Leviev’s businesses have recently been renounced by Oxfam International and UNICEF due to Leviev’s construction of Israeli settlements on Palestinian land in the West Bank in violation of international law. Companies owned by Leviev’s partner in settlement construction, Shaya Boymelgreen, are now being sued for war crimes in Canada.
